Road Traffic Accident Claims

By far one of the most common types of accident claim within the UK are road traffic accident claims which account for over 40,000 serious injuries each year. JS Miller Solicitors act for claimants who have been injured as a result of another’s negligence.

This would include injuries received either as a driver, passenger, pedestrian, or a victim of a hit and run.If you are the victim of a hit and run, if the driver of the vehicle which hit you is uninsured then we are still able to recover compensation for you.

Whether you have sustained a moderate whiplash injury or a more serious injury, JS Miller Solicitors have the experience and resources to recover compensation for you with speed whilst taking care to ensure we maximise your award of damages.

Computerised RTA Claim Portal

Since 2010 a streamlined way of dealing with road traffic claims valued at less than £10,000 has been underway. This has resulted in many of the firm’s clients receiving their damages far quicker than would have been the case under the old regime. For more details of how the claims process unfolds, check out this page detailing the case procedures for this category of  personal injury claim.

How Do We Do Things Differently?

Lots of firms (especially the larger firms your insurers may try to appoint to act for you) have a “conveyor belt” process for claims resulting from road traffic accidents. To maximise their profits they often employ unqualified “paralegals” to deal with claims and you may find that you never actually speak to your legal adviser but that they send you numerous questionnaires to complete about your accident and injuries. This is done so that you actually do their work for them.

At JS Miller we believe in providing a service tailored to your needs. If you want to speak to us over the phone, arrange to meet with your lawyer in person or deal with us by e-mail/letter, you can! In fact, we will ask you how you want us to communicate with you rather than making assumptions about this. We are convinced that by having this approach, we have recovered thousands of additional pounds for our clients they would not have received if they had been represented by another firm. This is because, by taking the time to talk to our clients, we naturally discover more information about your personal circumstances and we are able to utilise this information in our negotiations. Some examples of how we are able to recover significantly more than our competitors are set out below:

Diminution

In certain circumstances, the value of your vehicle may have been reduced as a result of the accident, even if it has been repaired perfectly. Sometimes a claim for diminution can be significant, especially if your car is worth more than £20,000.00 to begin with.

Holiday expenses

You may be unaware of items of compensation you can claim for following an accident. If you were intending to go on holiday but had to cancel the trip, we can claim for the cost of the cancelled holiday (If not covered by your insurance) AND we will also argue you should be entitled to additional compensation because of the disappointment a cancelled holiday involves.

Alternatively, if you go on holiday but don’t enjoy it because, eg. Your leg is in plaster, we will recover more compensation for you because of your loss of enjoyment. If you fill in a questionnaire, this information is unlikely to come to light.

Hairdressers’ fees

We acted for a lawyer who was in a road accident. She transferred her case to us from another firm. Her injuries meant she was unable to lift her arms and dry her hair with a blow dryer so that she looked presentable for her work.

She therefore went to a hairdresser’s salon twice a week to have her hair blow dried whilst she recuperated. We were able to recover more than £1000.00 for hairdresser’s fees.

Internet Shopping Fees

By speaking to a client we discovered that they were doing their shopping online because they were unable to drive and carry heavy shopping bags due to their injuries. We were able to include these expenses as a legitimate part of the claim.

Gym membership fees

Many clients attend a gym and pay by direct debit for their membership. Whilst some gyms are prepared to suspend payments if you are injured and unable to use the facilities, some are not. We always check if you have any expenses such as these to recover at the outset of the claim as this cost can be significant.

Gardening fees – orchard

We had a client who had a huge garden with an orchard which she was unable to maintain following her accident. We attended her garden to take photographs of it so that he could demonstrate to her opponents the extent of the work that was required for its maintenance. We were successful in recovering additional compensation for the gardening expenses our client incurred.
