Accidents in America
If you were injured whilst abroad in the USA, you may have a right to claim compensation through the American Courts or it may be more beneficial for you to sue the responsible party through the British legal system.
Jeanette Miller and her team have pursued Accidents in America personal injury claims with a number US attorneys since the firm was first founded ranging from asbestos related illnesses to road accidents in Florida and a hot air balloon ride accident.
In America the legal system is very different to the UK personal injury claims process. For starters, in the vast majority of US claims, the amount of compensation to which you may be entitled is substantially more.
A further difference between American personal injury claims and those pursued through the UK is the way in which the legal fees are paid. In the UK, “No win no fee” means that if you lose your case, you will not have to pay any of your own lawyers’ fees but you may still be liable to pay for those of your opponent and other expenses of your own such as medical report fees. If you win your case in the UK, you will be able to claim your legal fees from your opponent in addition to the compensation payment.
In an American personal injury claim, you will be required to pay all of your legal fees by way of a percentage deduction from your compensation award. This is why the amount of compensation you typically receive is a lot more than the amount you recover in the UK.
Most US attorneys charge a percentage of between 25-33% of your compensation. So if you recover $100,000 for your case, you would have to pay between $25,000 and $33,000 in legal fees.
If pursuing a claim in the USA, we can assist the US attorney in gathering the evidence they need, such as statements, medical records and medical reports. We do not charge you anything extra for this service but the US attorney pays us for the work we do out of their fees.
We will take care of the headache of the time difference between us and the US attorney and liaise with them on your behalf so that you don’t have to.
