Broken Equipment or Products Claims

You have the right to claim compensation should you be injured as a result of using a defective product.

Employers are under specific obligations to ensure that work equipment is in working order but defective products that cause injuries to members of the public can also be the subject of a personal injury claim.

JS Miller Solicitors have succeeded in claiming compensation in a number of cases where a product was defective. Some examples are:

Injury caused by defective stepladders

Our client was standing on some stepladders which collapsed as she was standing on them suffering injuries. The ladders had been used in accordance with manufacturers’ guidelines and after a bit of a fight we were able to settle the claim out of court for £1500.00

Defective shoes

Our client had bought some shoes to wear to a family event but unfortunately the heels of the shoes gave way due to the glue used on the heel being below standard.

Initially the shoe store that the shoes were purchased from denied responsibility saying the Portugese manufacturer was to blame but eventually the UK insurers agreed to compensate our client and we recovered £4500.00 for our client.

Injuries arising from unsafe medication

There are a number of claims against drug companies, particularly in the US, where harmful side effects were known by the drug manufacturers.

One of the most recent and common claims relating to medication which is unsafe is in connection with Pradaxa, an anti-coagulant drug. Fairly new to the UK market, it is considered by many practitioners as a better alternative to warfarin because there is not need for regular blood tests when taking it. However, as is often the case in the US, there have been major claims brought because of irreversible side effects of this drug including heart attacks, Gastro-Intestinal Bleeds and severe abdominal pain.

Please note that the way personal injury claims are funded will change from 01/04/2013.From this date success fees and after the event insurance premiums are no longer recoverable from the Defendant if the claim is successful and are payable by the Claimant from their damages. If you have been injured in an accident and wish to make a claim and do not want to have to pay up to 25% of your damages in success fees please contact us immediately.

Please be aware because of the bank holiday we will not be able to obtain insurance or take claims under the old regime (i.e. where no deductions are made from your damages) after 12pm on 28/03/2013.
