Accidents Abroad

If you are unfortunate enough to have an accident whilst abroad whether you are on holiday or not, J S Miller Solicitors will be able to assist you in pursuing a claim.

If your accident happened whilst you were on a package holiday it may be that your tour operator is liable for what happened as they are duty bound to ensure that their customers are not exposed to unnecessary risk of injury or disease whilst abroad.

If you were not on a package holiday, you may still be entitled to claim compensation against a foreign defendant. For example, if you suffer an injury in a car accident in America, because the US system is far more generous than the UK system for compensation, it is preferable to sue in America.

Unlit stairwell

Our client was on the last night of his holiday in Cyprus with two of his friends. They were going to a bar inside their hotel complex and were using a stairwell that led directly to the pool area because the lift was out of order.

As they went down the stairs it became much darker as no lighting was available. The lighting became so poor that they were unable to see in front of them and our client tripped and fell down several steps injuring his ankle.

The tour operator responsible for the package holiday denied responsibility saying that they had complied with foreign legislation. This is a common defence raised by tour operators in accident claims abroad such as this. We were not prepared to accept this defence as from a logical perspective; no country would have a law that justified a public stairwell to be pitch black!

Eventually we succeeded in recovering an award of compensation of £2500.00 for our client.

Slippery swimming pool

Our client was a young boy who was injured whilst on holiday with his family. He had slipped on the edge of a swimming pool which was extremely slippery. The anti-slip coating around the pool had worn away and several holiday makers had suffered similar accidents but, fortunately without any serious consequences.

Our client suffered a nasty gash to the back of his head which left a permanent scar.

We sued the tour operator who denied responsibility for the accident claiming the pool surround was not slippery. We were able to track down other holiday makers and obtain statements from people who were able to confirm that several people had suffered similar slips.
